Locomotion R-Genex and Xyz Monsters
Besides being my favourite synchro monster ever, Locomotion R-Genex is also pretty easy to bring out in the current meta (Chaos Sorcerer in Dragons, Inzektor Giga-Mantis in Inzektors; with Genex Ally Birdman etc.). Permanently taking control of an opponents monster has always been a powerful effect (see Change of Heart and Snatch Steal being banned), so I was wondering, how does Locomotion R-Genex interact with xyz monsters? The text on the card reads:

1 "Genex" Tuner + 1 or more non-Tuner DARK monsters
When this card is Synchro Summoned, take control of the face-up monster your opponent controls with the highest Level. (If it's a tie, you get to choose.)

So, I would like to provide a couple of situations where I could summon R-Genex and hopefully find out what occurs in each. Before I give the examples, I would like to make it clear that I understand that ranks are not levels, and that xyz monsters are not treated as having levels.
1. My opponent controls a non-xyz monster and an xyz monster, do I?
Quote:
a) Take control of the non-xyz monster
b) Take control of the xyz monster
c) The effect fails
d) I can choose
Justification:
a) Not having a level is treated as being lower in level than any actual level
b) Not having a level is treated as being higher in level than any actual level
c) Since the xyz monster does not have a level, the effect cannot determine which of the two monsters has a higher level, so I can't take control of either
d) See above, except because the higher level cannot be determined, it is treated as a tie.

2. My opponent controls one xyz monster and no other monsters, do I?
Quote:
a) Take control of the xyz monster
b) Do not take control of the xyz monster
Justification:
a) Since its the only monster my opponent controls, it must have the highest level regardless
b) Since it is not treated as having a level, I can't take control of it

3. My opponent controls two (or more) xyz monsters, do I?
Quote:
a) Choose which to take control of
b) Don't take control of either
Justification:
a) Neither of them have levels, so it is a tie, and I can choose
b) Neither of them have levels, so I can't take control of either of them

Thanks for having a read, any input on this matter would be greatly appreciated. I feel that all my arguments have some justification to them, and this has caused some disputes at my locals before, so I would like to clean the matter up.

Xyz Monsters don't have Levels. "Locomotion R-Genex" does not count them for its effect, as if they weren't there to begin with. You do exactly what the card tells you: Take control of the monster whose Level is highest.

If it talks about level, Xyz monsters are exempt. Period. No debate. Nothing to discuss.

So to answer the questions:
1.You take control of the non-Xyz. It is the only monster with a level and therefore has the highest level.
2.You don't take control, Xyz doesn't have a level.
3. Assuming they only control Xyz monsters, same as 2.
