There's really only, what? 4 lol!
In order, and Why....
1: Uchiha Itachi. Itachi took the right road, if you ask me. While he killed off his family, he's got that Strong Silent type thing down that Sasuke kind of missed. Sasuke turned EMO, while hsi brother, who paints his nails purple, including his toe nails, and wears nothing but black and red is less EMO than Sasuke... Which is sad, if you ask me....
2: Orochimaru. He's got that crazed Killer/Michael Jackson thing working. I absolutly love how he uses his subordinates for what ever he damn well pleases. Come on. Dosu and Kin for the sacrifices for the summonings of the First and Second... I especially liked how when Kimimaro died, Orochimaru was all, "What ever. I got Sasuke coming. I don't care about boney anymore."
3: Of all the choices I could still make, Kabuto tops the list after these 2. He has that urge to impress Orochimaru, while still being a pissy jerk all at the same time. I think that if he was a bit stronger, he could branch out into his own villan, but I don't think that he has it in him at this point in time.
Those are my top 3. Like it or not, that's the breaks.

Kin Tsuchi. Her hair is hotter than Sakura's. As is the rest of her.
And Itachi for being cool and 1337.

Orochimaru because he's the only one supporting yaoi in the series other than Haku and Zabuza. =P

Anyways, Itachi for some obvious reasons. So far he is one of the strongest shinobi we've seen so far, and no doubt one of the coolest.

For some reason, although a bit short, Sasori would be my pick for fav villian
He has the attitude that makes him impatient. He doesn't hesitate killing his enemies and he doesn't even have a body. Also being able to control the 3rd Kazekage with ease just proves his strengh. Too bad he's dead
Deidara wasn't the bad guy that Arc, Sasori was

I like Itachi. His power and mysteriousness just makes me amazed. Also, Kabuto is my second favorite because for some weird reason, he is cool.

Kimimaru if I'm not mistaken. (Not 100% on that, seeing as I havn't gotten that far into the show.)
As for my favorites...
Itachi, because...well...he slaughtered his entire clan...
Orochimaru because...well, quite frankly, he creeps the living hell out of me.
and third would be Haku, not for reasons in the show, but for the fact that one of my friends was CONVINCED he was a she, even after he said "Oh, and by the way...I'm a guy" to Naruto. :D
Haku is my faviorte villian, if you can really count him as one.

Itachi is just awesome, uber strong + emo dress sense = kewl
Sasori's my second favourite though, I especially liked the part where he summoned his 100 puppets. I like most of the Akatsuki as well.

His name is Kimimaro, and yeah, he is pretty cool. Too bad he got this sickness. From what I've seen, it looks like tuberculosis.
1. momochi zabuza.... he is just that awesome and i screamed when he died
2. orochimaru.... he's creepy, he's a snake, wat's not to love?
3. itachi.... i'm around emos all the time.... yes, he is like, the strongest villain, but that just takes the fun away from him being cool

My list would be very similar to your's except number three would be Kimmimaro and Kabuto would be number four. Kimmimaro is self-explanatory.
