Horus LV 6 and Creature Swap

Hello. I did a search on this but couldn't find an answer to my question. I'm sorry people.

I know that if Horus the Black Flame Dragon LV6 is the only monster my opponent controls, I can activate Creature Swap, but it will disappear.

However, what if my opponent has Horus AND another monster. Is he obligated to choose the other monster, or can he still choose Horus, thus making my Swap disappear?

since horus is elligible for the effect, but it's unaffected, he can choose horus lv6 and then the effect will dissappear

I think your opponent can still choose horus lv6 thus making your creature swap to dissapear.
